Rock Climbing Waiver and Release of Liability Notice: THIS IS A LEGALLY BINDING LIABILITY RELEASE, WAIVER, EXPRESS ASSUMPTION OF RISK, INDEMNIFICATION, AND AGREEMENT NOT TO SUE (the “Release”) THAT AFFECTS YOUR LEGAL RIGHTS.
In consideration of my being permitted by Dynomite Bouldering to use its Climbing Gym, and/or participate in any climbing program offered by Dynomite Bouldering. Including, but not limited to, climbing lessons, training, birthday parties, rentals, special events, etc.
I agree to the following waiver and release and I make these following representations:
I HEREBY ACKNOWLEDGE THE INHERENT RISKS IN ROCK CLIMBING , including climbing on artificial surfaces. I realize that bouldering, rock climbing, slack lining and the use of hang-boards, campus boards and other rock climbing training equipment including free weights are dangerous recreational activities which involve inherent, incidental and significant risks including but not limited to: falls from or contact with walls or equipment, bad decision making, inattention or actions of other climbers, misuse or failure of equipment, holds which may have become loose or damaged, and accidents which cannot be foreseen. I acknowledge that the above list is not inclusive of all possible risks associated with the use of the facilities, and/or the sport of climbing and I agree that said list in no way limits the extent or reach of this release. The activities may cause death, physical injuries (including fractures, hyperextension, overuse injuries, cuts and abrasions, sprains and head trauma) and psychological injuries (including panic attacks, hyperventilation).
I VOLUNTARILY ASSUME ALL RISKS WITH FULL KNOWLEDGE AND APPRECIATION OF THE DANGERS AND RISKS INVOLVED.
I voluntarily agree to assume all risks of personal injury, including paralysis and death, which may occur while I am in the Climbing Gym, or participating in any event, program, birthday party or training at any time, whether or not under supervision of Dynomite Bouldering personnel. I hereby knowingly and intentionally waive and release any and all claims or causes of action which might arise from use of the Climbing Gym or participation, and agree to indemnify, hold harmless and defend Dynomite Bouldering, its successors, assigns, officers, employees, volunteers, wall designers or builders, manufacturers, lessors and agents from all liability for any such damage, injury, paralysis or death which may result. This Waiver/Release shall be effective even though said loss, damage or injury results or has resulted from negligence, wrongful acts, omissions, breach of warranty or strict tort liability of Dynomite Bouldering or the other parties released.
Dynomite Climbing Gym Rules and Etiquette

Indoor bouldering can be an incredibly safe, fun and social sport when simple common sense rules and etiquette are maintained. For your own enjoyment and safety, as well as that of other patrons, please be familiar with and follow the Bouldering Rules and Etiquette guidelines below. If you have any questions please do not hesitate to ask our staff.
Please note: Dynomite Staff reserve the right to refuse a new or existing patron entry to facility, and or ask patrons to leave facility, if they believe that safety or comfort of that individual or other patrons is in question.
Bouldering Rules
Accept
responsibility for your actions. Bouldering as with most sports has its
inherent dangers when safety rules aren’t followed.
Due
to the dynamic nature of bouldering, be aware and keep clear of other climbers
on the wall at all times.
Be
responsible for your safety. Only climb as high as you are comfortable to fall
or jump down.
Where
a boulder tops out, do not jump down from the top of wall to the mats. You must
down climb via an easy route utilising any holds for hands and feet. If in
doubt ask staff before attempting the boulder.
No
running, loitering or lounging on crash mats.
Clean
shoes only to be worn on safety matting and for climbing on bouldering walls.
Street shoes will have to be presented at counter on entry to facility
No
food or drinks on mats
Strictly
no drug or alcohol policy
No
loose chalk or chalk bags on mats
Children
under 16 must be accompanied by an adult.
· One climber per wall section. The only other people permitted to be standing on mats are active and alert spotters where necessary
· Once finished attempt on boulder, move off matting to allow other climbers to take turns
Brush
holds frequently
· Report any spills immediately to staff
· Report spinning holds immediately to staff.

COVID-19 rules and gym regulations
· Participants are asked to sanitise hands on arrival to gym, regularly throughout their session, after using toilet/change room and upon leaving the premise.
· Upon entry to the gym, participants to store one bag in designated area only.
· Participants to come dressed in suitable attire and prepared for bouldering (shower facilities are not available; however participants may change in change-room if necessary).
· All participants to maintain social distancing as per 1.5metre rule
· Zones will be marked out and signage displayed to help participants adhere to social distancing.
· Participants to use liquid chalk only (no loose chalk)
· If showing any respiratory symptoms or otherwise ill please do not attend the gym
· Staff reserves the right to ask patrons to leave if they are suspected of being ill or are not adhering to gym rules and regulations.
· As we may be catering for limited numbers to maintain a safe environment your time in the gym may be limited and require a booking. In which case participants are asked to ensure completion of use of facility 10 minutes prior to end of booking to ensure safe transition to next group.
I am in good health and have not any known physical limitations, which affect my use of the Climbing Gym. I agree to pay attention to the state of the mats, holds and other equipment I may use, and to advise staff members if I do any damage or notice damage or problems. I certify that I have read the posted rules, and accept responsibility for failure to abide by these rules. If Dynomite Bouldering Personnel makes a specific request of or instruction to me, I agree to comply.
I am at least 18 years of age and otherwise legally competent to sign this agreement. This waiver/release shall be effective and binding upon me and upon my assigns, heirs, representatives, guardians and administrators.
I understand that this waiver/release is a contract. I expressly state that I have read, understand and am familiar with all its provisions and that I sign it of my own free will. I also agree to follow the rules and etiquette listed on this document.
Privacy policy: Dynomite Indoor Climbing Gym Pty Ltd has a strict privacy policy for all customer data. Any collected personal data is kept private and confidential and stored in a secure protected server. The sharing of personal data with other 3rd parties is strictly not permitted. Personal data will only be released to relevant authorities if required to do so by law.
